Выявлена тенденция растущего распространения альтернативных санкций в процессе досудебного разбирательства, при вынесении и при исполнении приговора. Анализируется эффективность альтернатив тюремному заключению в разных зарубежных государствах. Отмечается существенная разница в доступе к альтернативным санкциям в зависимости от того, является ли человек гражданином или иностранцем. Авторы приходят к выводу, что, хотя такие санкции не коррелируют с изменением уровня преступности, они способствуют гуманизации уголовного правосудия и являются одним из инструментов борьбы со всеболее карательным подходом к контролю за преступностью</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>This article examines alternative forms of punishment in foreign criminal justice systems. A trend toward the increasing use of alternative sanctions during pre-trial proceedings, sentencing and execution of sentences is identified. The effectiveness of alternatives to imprisonment in various foreign countries is analyzed. Significant differences in access to alternative sanctions are noted depending on whether the individual is a citizen or a foreigner.
